Town Board

OCTOBER 13, 2010                                          
     A regular meeting of the Jewett Town Board was held on Wednesday, October 13, 2010.  The meeting was called to order by Supervisor Carol Muth at 7P.M.  Present were Board members Steve Jacobs, Michael McCrary, James Pellitteri, William Trach, Superintendent of Highways Robert Mallory, Attorney for the Town Tal G. Rappleyea, town residents Werner and Helga Pscherer, newspaper reporter Mike Ryan and the town clerk.

     The Supervisor’s September financial report was given to the Board prior to the meeting and bank statements were reviewed by the Board.

     Councilman McCrary made a motion, 2nd by Councilman Jacobs and carried accepting the minutes of the September 8, 2010 regular meeting and the September 15th and October 6th budget meetings. 

     The Superintendent reported that he has applied to FEMA for damages during the September 2010 rain storm.

     Councilman McCrary made a motion, 2nd by Councilman Pellitteri and carried to accept the Building Inspector’s report subject to an update about the property on Round Hill Road.

     Councilman Jacobs made a motion, 2nd by Councilman Trach and carried to accept the Zoning Officer’s report.

     Councilman McCrary made a motion, 2nd by Councilman Pellitteri and carried to adopt Resolution #19.  A Resolution Authorizing Application for Funds from the 2010 Justice Court Assistance Program.
     “RESOLVED, the Town Board of the Town of Jewett, Greene County, New York hereby authorizes Town Justice Stephen Canfield to file an application for funding from the New York State Office of Court Administration 2010 Justice Court Assistance Program”.

ROLL CALL VOTE: AYE Muth, Jacobs, McCrary, Pellitteri and Trach.

     A Public Hearing is scheduled for the November 10, 2010 meeting on Local Law #7 of 2010, a Dog Law.
     Councilman McCrary made a motion, 2nd by Councilman Pellitteri and carried proposed the following dog license fees; for spayed and neutered dogs $15; for unsprayed and unneutered dogs $25; guide dogs, war dogs, police dogs, detection dog, therapy dog, working search, hearing and service dogs are exempt.  A $10 fee will be charged for a lost tag.

     Councilman Jacobs made a motion, 2nd by Councilman McCrary and carried approving the budget as the preliminary budget for 2011. 

     Councilman McCrary made a motion, 2nd by Councilman Pellitteri and carried reappointing Laurie Hanenberg to the Board of Assessment Review.  This is a five year term and will end on 9/30/2015.

     Councilman McCrary made a motion, 2nd by Councilman Jacobs and carried adopting Resolution #20, Hamlet Expansion.  This resolution reads:
     “WHEREAS, the Town of Jewett recently completed a Comprehensive Plan, which determined and recommended, among other things, that in order for the town to successfully plan for its future, land suitable for development must remain available in and near the existing Hamlets; and
     WHEREAS, the MOA between the City of New York and the several local municipalities within the watershed requires the definition of certain ‘hamlet’ areas in which the New York City Department of Environmental Protection (NYCDEP) shall purchase real property in the context of its Land Acquisition program and that such definition must be reviewed and modified, as is appropriate, on a repeating 5-year basis; and
     WHEREAS, the Town board of the Town of Jewett recognizes that in the current economic atmosphere, there appears to be little opportunity for development within the Town and that the Town Board must balance the goals and recommendations of the comprehensive Plan in conjunction with the NYCDEP Land Acquisition program.
      NOW,THEREFORE, BE IT RESOLVED that the Town Board of the Town of Jewett hereby establishes that the Hamlets within the Town shall be as reflected in the final proposed plan and that the Town shall, in accordance with the terms of the MOA, shall re-examine, and modify as appropriate, the definition of such Hamlet designation no later than the 5-year anniversary of this Resolution.”

ROLL CALL VOTE: AYE Muth, Jacobs, McCrary, Pellitteri and Trach.
                                                              

     Bills were audited prior to the meeting by all Board members.  The general fund was $12,463.11 on abstract #10, claim numbers 230 to 263.  The highway fund was $40,712.33 on abstract #10, claim numbers 145 to 166.

     Councilman Pelitteri made a motion, 2nd by Councilman Trach and carried to accept the Supervisor’s August financial report.

     Councilman McCrary made a motion, 2nd by Councilman Jacobs and carried to adjourn at 9:15 P.M.
